A container installed permanently and used as a habitable room requires a permit virtually everywhere.<\/p>\n<h2>Permit required or exempt? The 4 factors<\/h2>\n<ol>\n<li><strong>Use<\/strong> \u2013 pure storage is the least problematic. As soon as people spend time in it on a permanent basis (office, workshop with a workstation, living), stricter rules apply.<\/li>\n<li><strong>Size \/ volume<\/strong> \u2013 the state building codes specify a threshold below which storage buildings are exempt from the permit procedure, usually as gross volume in m\u00b3. A 20 ft container has a gross volume of approx. 38 m\u00b3, a 40 ft container approx. 76 m\u00b3.<\/li>\n<li><strong>Duration<\/strong> \u2013 containers placed only for the duration of construction are usually exempt from the permit procedure. However, \u201ctemporary&#8221; is not defined the same way nationwide.<\/li>\n<li><strong>Location \/ federal state<\/strong> \u2013 each state building code (LBO) regulates this independently; in addition, development plans, heritage protection and setback distances may apply.<\/li>\n<\/ol>\n<h2>Container in the garden \/ on private property<\/h2>\n<p>As a <strong>storage containers<\/strong> it can be placed on private property without a permit procedure in many federal states, as long as the volume stays below the threshold of the relevant LBO and there is no permanent structural connection. Please note:<\/p>\n<ul>\n<li><strong>Boundary distance<\/strong> \u2013 usually 2,5 to 3 m from the property boundary; directly on the boundary only under strict conditions.<\/li>\n<li><strong>Development plan<\/strong> \u2013 may restrict or exclude ancillary structures.<\/li>\n<li><strong>Use<\/strong> \u2013 a \u201cgarden house&#8221; container used for occupancy is not exempt from the permit procedure.<\/li>\n<\/ul>\n<p>If in doubt, send an informal enquiry to the building authority \u2013 it costs nothing and gives you certainty.<\/p>\n<h2>Container on a construction site<\/h2>\n<p>Containers for site facilities (materials, office, sanitary) are generally exempt from the permit procedure for the duration of the construction work. They must be removed once the work is complete. Exceptions: very long construction periods, placement in public space (a special use permit is then required), protected areas.<\/p>\n<h2>Container for business \/ permanent use<\/h2>\n<p>For commercial or permanent use, a building permit application is usually required \u2013 in particular for a change of use (storage \u2192 sales room, office, habitable room), placement as an independent structure above the threshold, and connection to utility and sewage lines.<\/p>\n<h2>Building permit by federal state \u2013 overview<\/h2>\n<p>The maximum size of a storage container that may be placed without a permit (\u201cexempt from the permit procedure&#8221;) differs from state to state and is set out in each federal state's building code, for example in the Hamburgische Bauordnung (HBauO), the Bayerische Bauordnung (BayBO) or the Landesbauordnung Baden-W\u00fcrttemberg (LBO BW). Your local building authority can tell you the current threshold for your federal state and your use.<\/p>\n<p>The current version of the state building code and the information from the local building authority are always decisive.<\/p>\n<h2>Foundation, anchoring and structural stability<\/h2>\n<ul>\n<li><strong>Free-standing placement<\/strong> on concrete slabs or compacted gravel is the most likely to retain exemption from the permit procedure.<\/li>\n<li><strong>Pad or strip foundation<\/strong> may be considered a \u201cstructural connection&#8221; and change the permit situation.<\/li>\n<li>In wind-exposed locations, <strong>anchoring<\/strong> is advisable \u2013 this is a matter of structural stability, not automatically of permits.<\/li>\n<\/ul>\n<h2>How to submit a building permit application<\/h2>\n<ol>\n<li><strong>Contact the building authority<\/strong> \u2013 a preliminary building enquiry clarifies in advance whether a permit can be granted.<\/li>\n<li><strong>Compile the documents<\/strong> \u2013 site plan, construction drawing\/description, details of use and dimensions, and if applicable proof of structural stability.<\/li>\n<li><strong>Submit the application<\/strong> \u2013 via the municipality or the building control office, usually through a planner authorised to submit building documents.<\/li>\n<li><strong>Wait for the decision<\/strong> \u2013 processing time ranges from several weeks to months, depending on the authority.<\/li>\n<\/ol>\n<h2>Common mistakes<\/h2>\n<p>Permanently installing a container without checking first, ignoring the minimum distance to the property boundary, declaring it as \u201cstorage&#8221; and then using it as a workshop.
